Yes, definitely go and see a good agent as my case where they consider I presented a bogus document falls into a different pic criteria than yours, but it is possible getting your visa refused if you have a ban. I found out the worst way and even my lawyer told me the ban wouldn’t apply but it did... Hope everything works out for you.
  2. Yes. Definitely find an agent. I had a very good immi lawyer and we did everything we could and still didn’t work. Just thought would be good to share what happened to me, cause immi treated my application like any other, they asked me all normal documents and in the end told me my visa was being refused due to the ban. I can’t even describe how I felt, cause all these blogs and my lawyer, they all told me the ban didn’t apply for a parter visa, especially such a long term relationship. Worse experience of my life...
  3. Yes, when you apply you need to present compelling and compassionate reasons of why they should overlook and lift your ban. If they accept they will give you a visa. In my case, even thou I presented reasons that in fact affected an Australian business and an Australian citizen, they decided wasn’t good enough and after leaving me to wait 8 months they refused my visa once again. I hope you have a different outcome. Good luck.
  4. Yes they are. I had my partner visa refused after having a ban. I’ve been with my partner for nearly 5 years. I had my partner visa refused back in 2016 due to immigration thinking I presented a “bogus” document and they refused and banned me for 3 years. So everyone kept on telling me the ban didn’t apply for the partner visa and even thou I’ve been with my partner for years I left the country and applied overseas and they refused my visa again, saying I didn’t have enough compelling and compassionate reasons to be applying before the ban. So now my fiancé had to sell everything we owed, had to rehome our cats and leave Australia to be with me until the ban is over and I can reapply, so it’s safe to say that the ban doesn’t apply for the partner visa is wrong.

    Thank you for replying. I haven't waited out the 3 year period. My ban has been lifted after I applied for my PMV. They requested compelling and compassionate reasons to accept my application. I provided and they accepted. Now, we just wanted to be together until a decision can be made, even if I have to leave the country when immi is ready to make a decision... the only thing is, can I? Thanks
  8. Hi there Seeking some advice from someone who's been in a similar situation or from a migrant agent. I had a 3 year ban attached to my passport, due to an application for a partner visa gone wrong onshore. Now, I'm off shore, waiting for my PMV visa and the ban has been lifted. My question is: Do I have a chance to be grant a tourist visa to wait for my PMV visa with my fiancé in Australia? Thanks in advance for anyone that could help me.

    Hi Aussie_83 I didn't think it was a rule, I just though that maybe that's what happened. Ive seen people get their visa about at least a month after proving evidences/providing info - you are the first ones that didn't get after a month that I've came across. Maybe because of the countries we are applying from are high risks. Idk. But thanks for your timeline, at least now I know I'm anxious for no reason.
