Hi guys, I just want to know, I applied offshore partner visa when left Australia before through Australian Migration agent.. In June 2016...i have submitted medical, police clearance. But I have got nothing from Australia immigration. Time is killing me very bad.. Way.. I missing my family.. Last visa refused bcs overstayed 28 days..... My case is normal...? Or complicated.... I can't see when I tried to check immmmi site.... Just getting error.
Anyone can help me plz

I got married in Australia 2012....its long relationship... Keep going on on...... But very badly killing time

What does your agent say?  12months is still inside the processing window, but I would suspect you would have had a Case Worker assigned by now.

 

Some agents are slack when it comes to updating their clients.

 

Also, your partner, the sponsor can email/ring DIBP in AU.

How can u say I got case officer has been allotted bcs neither agent told me or I can't see on immigration account.. Just shows msg an error.. I said couple of times.. He said they haven't got anything yet.... Last time he they got response from Immi they said it application still under standerd time.cud u tell me plz our case is normal or complicated.? I m really very sad to see today immigration site they increased global processing time now.. 18-21months...and my situation I cNt tell anyone.....

I did not say the CW would have been assigned, I said I would have expected a CW by this stage, but thats not a hard and fast rule.  With your previous overstay, I expect that DIBP will take a bit longer, but I doubt it will adversely effect your application.  Did you explain why you overstayed?

 

You need to get  the error on your IMMI account page fixed, via the online help system.

 

I can only suggest that your only option is to wait, patiently.  All seems to be progressing normally for you.

 

Yes, I agree, the delays are very frustrating.

.then again applied offshore.. With positive hope. And agent don't worry now ur case is clear.. But this delay scared me and killing me badly... Thx for ur help.. Cuz u tell me its simple case or complicated? How I would know I got caseofficer. Thxxxxx for helppp hope u understand my situation missing my family... So much.. Even how I can fix immigration account.. Which shows an error message when I open.. Thx

Since its over 3 years since your overstay, I think your application will be fairly simple.

 

As I said the delays are normal, but frustrating for you.

 

When a CW is assigned you will get a email or letter, with their name and details.

nd as I left Australia mid 2016..according u it means ban ll uplift from mid 2019....i mean some people applied from india they got visa.. But I applied from Australia by agent it takes too much time.. How come? ....my family stuck in Australia... I m in India... It has been waiting nearly 15 months..... No response ...when I ask to agent same thing again and again..... When I applied then processing time was 9-12 months..... Now 13-19monthsss....last thing how come I can fix up An error thing which I get when I open immigration account.

Hey Champ

To be frank your case is not simple, Its complicated. or as Immi Calls it complex nature,

 

All those cases that are complex nature can go over processing time, last I checked processing time is 13-16 months not 21 months as you mentioned. That is for 309 Sub Class.

 

At last complex nature are these: ( Overstay-Criminal Records-Refusal- MRT or AAT Appeals-Previous Relationships-Divorcee )

 

These all are complex.

 

Where did you apply it from? If i hear this right you applied from an agent in Australia?? what was your sub class, has to be 309, since you are offshore. Doesn't matter where your agent is from.. since your offshore your sub class is 309.

 

However you might be eligibile for a direct Sub class 100. Which is a direct PR

 

There are other couple waiting since june, hope you get your reply soon from Immi, unfortunately best you can do is to wait.. or apply for a tourist visa? but i believe that would be rejected too, mine was rejected.. Complex Case as well.

I just want to say my case is genuine relationship since 2012..i did married in mid 2012...now I applied offshore.. Only last time I did overstayed behind. I couldn't complete schedule 3..thats why after that mrt gonna refused.. But my agent told new case wouldn't affect in partner visa case..... I don't know but I missing my family...... Very badly...
I hope u can understand.. My situation

I left mid 2016 from Australia... I applied from Australia through immigration agent instead India.... I feel here people who applied from India that are getting more faster than anyone.... I could be wrong..... But this time.. U don't know Wat is right or wrong...... Bcsssss ur other half there.. And immigrantion change there rule faster than one S underware.....

that is right, even if you applied from agent in Australia, he would have lodged your file on IMMI from INdia- since it's all online. Or he would have posted your documents to Indian High Commission if you applied via paper. 

 

However its offshore.

 

Unfortunatey, your case is of complex as well, Mine is complex too- Refused previous Onshore visa as relationship ended- applied MRT to get some time- meanwhile got into a relationship with a new partner and applied offshore visa in Dec2016-

 By marrying legally. 

 

Did you ask your agent to email them? Since I believe your medical and pcc must have been expired as well..

Yes.. He send me email regarding pcc and medical Docs.. But I scare other side as well it cud be expire as well.. If they takes more than 18-19monthsbcsss 15months running to my case.... Don't knoewww.. But time is killing me badlyyyyyy

Hi guys... I just let u know.. In India australian immigration S people came at my home.... Asked questions.. About.. Myself did I marry here...it.. Like that thing... Didn't tell us straight come to our home didn't give us time we gonna nervous badly...
