Visa for Thai girlfriend

Hi Dave,

First up you'll need a ton of research and time and if you've only just started the relationship I would recommend not getting married until you are across all your options as just being married isn't enough to get a visa for her.

The partner visa numbers for onshore are 820/801 for that she would need a tourist visa without the 8503 condition which is unusual for a Thai.

The offshore partner visa is 309/100.

A PMV 300 would probably be a better option given its early days but even so would be better to get a few visits each way before looking at them.

But just a heads up this will take time and be costly. Also just a heads up be wary of the Thai's "someone say, people say, they say" especially when it comes to visas.

To apply for a partner visa in Australia, she must be in Australia at time of application, on a current visa, which does not have the condition 8503 no further stay attached to it. Secondly, to apply for a partner visa, at time of application, you both must be legally married or in a de-facto relationship at time of application, and meet the required genuine relationship criteria which can be found in the Migration Regulations.

Based on what you have posted, there is currently no partner visa eligibility. Your first challenge would be assessing whether she meets the genuine temporary entrant criteria for the grant of a visitor visa. Why the need to get married in Australia? a Thai marriage is recognised in Australia.

If you want to just get married in Australia, apply for a tourist and tell them that. Nothing stopping you getting married in Australia on a tourist visa except some hoops (paperwork) that you will need to jump though if you want that marriage to be legal in Australia.

Or just do a fake marriage for show here.

What hoops would they be?  Its a very simple process to marry a foreign national in Australia regardless of what visa they came in on

@Electric Sheep mentioned paperwork. Perhaps meaning getting any document translations done if need be, and then submitting the NOIM in time. Getting married is not something that can be done in a few days. Some people leave it too late and their visas ends before they can legally marry. However agreed, quite easy to get married in Australia.
